I'm no expert, but I bet if you do it randomly to strangers, it is some version of assault. If you get their permission ahead of time and just do it in public, as long as people are dressed appropriately, I think it's fine. They do it at fairs, fund raisers, etc all the time. But you can't just go smacking unsuspecting people with pies.
I've always liked the idea of an on the street/beach/where-ever gameshow, where you find a couple of (importantly) willing volunteers and they play a small game with the winner getting a small cash prize and the loser getting pied. Or a one player game where you ask them a question - get it right, they get the cash and get it wrong they get pied. And variations on the above. As long as they know what they are getting into that sort of thing should be fine. Random attacks - no.
As long as you get permission and a release (and clean up the mess in the street as appropriate) and (for the purposes of promoting and selling on this site) the participants are not apparently coerced whilst intoxicated.

Yup, or "littering" which near me will land you a $600 fine. Also, look into where you're going. For instance, if you do it in Vegas, you better have a performance license. One night we almost got kicked out of a place. I thought it was because Maria was too drunk. It turns out it was because she was drawing a crowd.
Years ago certain Chili's restaurants had this deal where you could pay to pie a server. I asked about it and the female came back and said they'd do it for $100. I felt bad if I refused so I went ahead and paid it. When I came back, there were quite a few employees gathered outside armed with their phones wanting to record it. We just used whipped cream. Get permission because you don't want to go to the police station smelling like dairy.
Being kind of an outsider to the pie thing I'll offer my two cents as a typical straight man with a very good sense of humor and fair play - My very attractive wife and I are out for a good time and somebody walks up and pies her is 100% going to get their ass kicked. And I do mean most thoroughly. And that's before I catch up with you.
I've gotten messy about 5 times in public places. Never got in trouble. Just some weird looks of humor and disapproval. I always pick up after myself though. As best ya can anyway!

BBC presenter Fiona Bruce was pied in public by 2 jokers who were taken to court over it. It's not on really. If Fiona Bruce has agreed to be in a comedy programme and pied then fine but not some weird pieing which is basically an assault.

Let's be clear. I don't think anybody is talking about attacking or 'sucker pieing' (if you will) members of the public here.
Obviously, you need permission of the participant. I'm not sure you really need a waiver. (it might make you seem more "official" if you want that detail, but it seems like overkill).
It would be nice to have a camera man or camera crew - film the entire interaction from start to finish. As long as it's clear that you're not doing something against the permission of someone, I can't imagine any trouble.
I would gladly support this endeavor. Do you have a type of game in mind? - like, have a couple of participants play against each other?
I'm thinking a general trivial game where I ask questions and if they get a certain number right they can Pie the interviewer and if wrong they get pied.
