A Mexican restaurant in the town I went to college in does something where they give you a tequila shot and then "pie" you while you're reacting to that but it's moreso like a bunch of whipped cream on your nose than it is a pie.
Nowadays I feel like a restaurant would get sued if they did something like that unless it was specifically requested beforehand.
I like to think that if people know it's coming or it's a 'spin the wheel' sort of thing, then no one would think about suing. I have always hoped that would happen to me!
There is a restaurant in Houston where if you order The Special, the waitress pies you mercilessly and repeatedly shoves your face into a giant bowl of pudding. And the only customers that go there are hot models. And there is this guy there who films the whole thing each time!
