Yes, it looks like it was from a comedy short 'Pie A La Mode" from 1933. Very little information (no video or photos except what I posted) are available. Maybe in some archive somewhere, hopefully not lost or dissolved.

PIE A LA MODE (1933) is an 18 minute short film directed by Roy Mack. And yes, that's Bernard Gorcey. The film was part of the Vitaphone series of comedy shorts, many of which have been released on DVD (VITAPHONE COMEDY COLLECTION, V1 AND 2) or have made their way to YT and other online sites. No sighting of this short in any of the collections, though.
By a very weird coincidence (Halloween influence?), I just watched BLACK DRAGONS (1942) on YT - a somewhat muddled "war at home" movie starring Bela Lugosi and Clayton "The Lone Ranger" Moore. The cabbie in one brief scene was Bernard Gorcey! Boy that guy got around!
